After arguing the Writ Petition for some time, Mr. Tripathi, learned Counsel appearing for the Petitioner seeks withdrawal of

36 WP 10789.23.doc the Writ Petition with liberty to file election dispute under Section 91 of the Maharashtra Co-operative Societies Act. 3.

Accordingly, the Writ Petition is allowed to be withdrawn and disposed of with liberty to file election dispute. 4.

It is clarified that this Court has not examined the merits of the case and all the contentions of the parties are expressly kept open.
