This is an application under Section 439 of Code of Criminal Procedure for bail.

The applicant came to be arrested in Crime No. 330 of 2022 registered at Akkalkot South Police Station, District Solapur, for the offence punishable under Section 364, 327, 323, 504, 506, 143, 149 of the Indian Penal Code (in short I.P.C.). 3.

I have heard the learned counsel for the applicant and the learned APP for the respondent/State.

According to the prosecution, the present applicant took hand loan of Rs. 25,000/- from the complainant and as a security handed over his motor to the complainant. It is alleged that the present applicant was asking the complainant to return his motor Ashwini J. Vallakati 1/2

2/2 911-BA-2814-22.doc without repaying the loan amount. It is alleged that as the motorcycle was not returned on 30/05/2022, the present applicant alongwith other co-accused abducted and assaulted the complainant by fist and kick blows.

The applicant is in jail for about four months. There are no criminal antecedents. The investigation is over. There appears to be some financial dispute between the parties. Considering the facts and circumstances of the case, I am inclined to release the applicant on bail. In the result, following order is passed:

ORDER

A) The Bail Application is allowed.

B) The applicant be released on bail in Crime No. 330 of 2022 registered at Akkalkot South Police Station, District Solapur, for the offence punishable under Section 364, 327, 323, 504, 506, 143, 149 of the I.P.C. on furnishing P.R. Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand) with one or two sureties in the like amount.
