Heard learned Counsel for the applicant and the learned A.P.P. 2.

By this application, the applicant seeks his enlargement on bail in connection with C.R. No. 37 of 2015, registered with the Umadi Police Station, Sangli, for the alleged offences punishable under Sections 326, 452 r/w 34 of the Indian Penal Code.

The complainant, who is also an injured in the present case has alleged that the incident in question took place on 6th August, 2015 at about 1/3

2/3 10 p.m., when three persons entered his shop viz. Santosh, Irgonda, and Prakash. He has alleged that all the said three persons assaulted the complainant with the help of hunter and wooden sticks. As far as the present applicant - Revgonda Irgonda Patil and his mother are concerned, he has alleged that they were present outside the shop, however did not enter the shop.

Perused the FIR. Considering the nature of allegations and the role attributed to the present applicant, the applicant is enlarged on bail on the following terms and conditions :

ORDER

(i) The applicant be enlarged on bail, on executing PR Bond in the sum of Rs. 10,000/- with one or two sureties in the like amount. 5.

The Application is allowed in the aforesaid terms and is accordingly disposed of.

It is made clear that the observations made herein are prima 2/3

3/3 facie, and the trial Court shall decide the case on its own merits, in accordance with law, uninfluenced by the observations made in this order. 7.
