We have heard Mr.Anturkar, the learned Senior Counsel for the Petitioner and Mr.Govilkar for Respondent. 2.

The Pharmacy Council under order dated 27 October 2022 rejected the Application of the Petitioner for the D.Pharma Course. The said Application was rejected on the ground that the Petitioner failed to obtain consent of affiliation of examing authority for the Academic year 2022-2023. 3.

Mr.Anturkar, the learned Senior Counsel pointed out that on 9 November 2022 the Maharashtra State Board of Technical Education has accorded consent of affiliation to the N.S. Kamble page 1 of 2

908-wp-11811-2022.doc Petitioner, as such the premise on which the Application was rejected by the Pharmacy counsel of the India does not survive. 4.

The learned counsel for the Respondent submits that the Petitioner has already filed an Appeal and the same would be decided.

According to the Petitioner, the Appeal is in the nature of the Application given to the Respondent (page 84). The Petitioner to provide proper legible copy of the same to the Respondent.

The Respondent may take decision upon the same on or before 21 November 2022.

The Writ Petition is disposed of. No costs.
