By this application, applicant is seeking regular bail in Crime No. 663 of 2024 registered with Karmala Police Station, District Solapur for offences punishable under Sections 103(1), 189(2), 190, 191(2), 115(2), 352, 351(3) of Bhartiya Nyay Sanhita, 2023.

It is the prosecution's case that on 9th October 2024 around 6:30 p.m. the applicant and co-accused had assaulted the first informant and his mother. In the said assault, the mother of the first informant is died.

It is contention of learned counsel for applicant that the allegations to beat the deceased are against the co-accused and not against the applicant. The applicant is behind bar around 1 year. Investigation is completed. charge-sheet has been filed. It may take time to conclude the trial. Hence, requested to allow the application. 4.

It is contention of learned APP that the applicant and coaccused assaulted the first informant and his mother on the ground of old dispute. There is involvement of the applicant in the crime and requested to reject the application.

I have heard both learned counsels, perused F.I.R. and documents produced on record.

The allegations of assaulting to the deceased Prabhavati are against the co-accused Rani Pandhare and Asha Pandhare. The allegations against the applicant are that he has assaulted the first informant with feast and kick blows. The applicant is behind bar around 1 year. Investigation is completed. Charge-sheet has been filed. There is no progress in trial. It may take time to conclude the trial. Considering that there are no allegation against the applicant to assault the deceased, I pass following order:

O R D E R

I.

The Application is allowed.

II.

The Applicant be enlarged on bail in Crime No. 663 of 2024 registered with Karmala Police Station, District Solapur on executing P.R.Bond in the sum of Rs. 20,000/- with one or two sureties in the like amount. III. The Applicant shall not tamper with the evidence or attempt to influence or contact the witnesses or any person concerned with the case.

IV.

The Applicant shall attend the Trial Court dates regularly.

The application is allowed in the aforesaid terms and is accordingly disposed off.

It is made clear that the above observations are made only for the purpose of granting bail and the Trial Court shall decide the case on its own merits in accordance with law and uninfluenced by the observations made in this order. 9.
