Learned counsel for the petitioner seeks withdrawal of the above Civil application which has been filed invoking Order XXXIX Rule 11 of the CPC, having regard to the fact that the breach which has been alleged is of the ad­interm order passed in the above Writ Petition. The learned counsel for the Petitioner seeks the withdrawal of the Petition with liberty to file a Contempt Petition. The Civil Application is accordingly allowed to be withdrawn with liberty as prayed for. Needless to state that the contentions of the parties are kept open to be urged at the appropriate time. Both the learned counsel are agreeable to the Writ Petition itself being finally heard as the challenge is to an order granting injunction. BGP.
