By a reasoned Order dated 5.9.2018 the applicant was granted interim relief.

Heard the learned counsel appearing for the applicant and the learned APP. Perused the record.

It is a matter of record that, the present crime is registered by the first informant Tukaram Khule is a counter blast to the crime registered by the brother of the applicant namely Navnath Kharat against the son of the first informant in the present crime and other accused persons under Section 307 read with 34 of the Indian Penal Code bearing CR. No.359 of 2018 with the same police station.

After perusing the entire record and taking into consideration the peculiar facts of the present case, this Court is of the considered view that, the custodial interrogation of the applicant for further investigation of the present crime is not necessary.

The interim relief granted by Order dated 5.9.2018 is hereby confirmed.

Application is allowed in the aforesaid terms. 6.

In view of the above order, the Intervention Application No.1160 of 2018 does not survive and is accordingly disposed off. (A.S. GADKARI, J.)
