After hearing the matter for some time and when this Court suggested that the main appeal itself can be directed to be disposed of within particular time limit and till that time some protection can be granted to the Petitioner, both Dr. Warunjikar, learned counsel appearing for the Petitioner and Mr. Chetan Patil, learned counsel appearing for Respondent No.4 agreed that no reasons are required to be given for passing this order. Accordingly, the following order is passed:-
ORDER
(a) Order dated 18th July 2023 passed by the learned Additional 1/2
18-wp-11103-2023.doc Sonali Divisional Commissioner, Pune Division, Pune dated 18th July 2023 in Appeal No.10 of 2023 is confirmed with certain modification as set out herein.
(b) Both the parties i.e. Petitioner and Respondent No.4 to appear before the learned Additional Divisional Commissioner, Pune Division, Pune on 25th September 2023 at 11.00 a.m. for fixing the schedule of hearing of Appeal No.10 of 2023.
(c) Learned Additional Divisional Commissioner, Pune Division, Pune is requested to dispose of Appeal No.10 of 2023 on or before 13th October 2023.
(d) Till the disposal of the said Appeal No.10 of 2023, the election to the post of Member of Gram Panchayat which has become vacant due to the disqualification of the Petitioner shall not be conducted. (e) The Writ Petition is disposed of in above terms with no order as to costs.
