By this Application, the Applicant is seeking transfer of Divorce Petition filed by the Respondent-Husband pending before the Civil Judge Senior Division, Vaduj, District-Satara to Family Court, Pune.

It is contention of the learned counsel for the Applicant that, the Applicant stays at Pune with her 13 years old son. The distance between Vaduj to Pune is more than 150 k.m. The Applicant is finding difficult to attend the Court dates at Vaduj. Hence, requested to allow the Application. N.S. Kamble page 1 of 3

The learned counsel for the Respondent submit that, the Applicant can attend Court dates at Vaduj. No sound reasons are given for transfer. The Respondent is ready for mediation. If this Court incline to allow the Application, the matter be referred for Mediation and to permit the Respondent to appear through Video Conferencing.

I have heard both learned counsel.

The Applicant stays with her 13 years old son at Pune. The distance between Vaduj to Pune is more than 150 k.m. The Applicant is finding difficult to attend the Court dates at Vaduj. Considering the reasons mentioned in the Application as well as it is settled principle of law convenience of the wife has to be considered while transferring the Petition over the husband. 6.

In view of above, I pass following order.

ORDER

(i) The Marriage Petition No.133 of 2023 pending before Civil Judge Senior Division, Vaduj, DistrictSatara be transferred to Family Court, Pune. (ii) Both the parties to appear before the concerned N.S. Kamble page 2 of 3

Court on 30th April 2024.

(iii) The Respondent can file Application before the concerned Court for appearance through Video Conference. The concerned Court shall decide the said Application on its own merits.
