The order impugned allowed the application under Order 7, Rule 11 of the Code of Civil Procedure, 1908 against which the petitioner has remedy of an appeal under Section 96 of the Code of Civil Procedure, 1908; hence, keeping all questions raised in the petition open to be agitated in appeal, the writ petition is disposed of with liberty to the petitioner to challenge the impugned order by way of an appeal.
