This is an Appeal against the judgment of acquittal for the offence punishable under Section 138 of the Negotiable Instruments Act, 1881. However, the Respondent Prakash Pundlik Chavan has expired and copy of death certificate issued by Grampanchayat Mahagaon, Taluka : Gadhinglaj certifying the date of death as 9th October 2009 is taken on record. It is marked as Annexure-X. 2.

The Appeal stands abated.
