The sole grievance of the petitioners raised in this petition is that they are entitled for compensation in accordance with the parameters laid down in the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. The stand of the petitioners is supported by respondent no.4 National Highway Authority of India. On last date, the petition was adjourned at the request of learned AGP to enable him to take instructions.
Dusane 2/2 20 wp 9993.2015 Mr. Sawant, learned AGP now on the basis of instructions from Mr. Shravan S. Kshirsagar, Deputy Collector, Land Acquisition No. 11 makes a statement that the compensation in respect of acquisition of petitioners' land shall be determined in accordance with the provisions of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. The statement is accepted.
In the light of above, Mr. Bhavake, learned counsel for the petitioners fairly concedes that the grievance raised in the petition does not survive. The petition is accordingly disposed of. We, however, direct the Special Land Acquisition Officer (SLAO) to conclude the proceedings of acquisition of petitioners' land and pass an award as expeditiously as possible and preferably within a period of two months.
