The Trial Court by the impugned order has rejected petitioner's application for rejection of plaint on the ground that the suit was not properly valued.

According to the petitioner, after the impugned order the petitioner has deleted the relief of declaration. Therefore, according to the petitioner, the suit is now covered by the judgment of the Supreme Court in Anathula Sudhakar v. P. Buchi Reddy (Dead) By Lrs & Ors., reported in AIR 2008 SC 2033 : 2008

The writ petition accordingly stands disposed of. No costs. 4.

It is open for the petitioner to raise this objection at the time of hearing of the suit.
