This is an application under Section 439 of Code of Criminal Procedure, 1973 for bail.

The applicant came to be arrested in Crime No. 49 of 2022 registered at Umadi Police Station, Sangli for the offences punishable under Sections 302, 307, 341, 143, 147, 148, 149 and 506 of the Indian Penal Code and Section 4 read with 25 of the Arms Act and Section 135 of the Maharashtra Police Act. 3.
The bail is sought on the ground of parity.

The Hon'ble Supreme Court by order dated 10.07.2024 in Criminal Appeal No. 2857 of 2024 granted bail to the coaccused Tejaskumar alias Yalappa Gundappa Salunkhe alias Bhat. The Hon'ble Supreme Court has granted bail to the said co-accused on the ground of long incarceration as under-trial prisoner.

The learned counsel for the applicant submits that the present applicant and the said co-accused - Tejaskumar were arrested on the same day. The learned APP has not disputed fact that the present applicant and the said co-accused Tejaskumar were arrested on the same day. In that view of the matter, I am therefore, inclined to release the applicant on bail. Hence, the following order is passed:
ORDER
a.
The Application is allowed.
b.
The applicant be released on bail in Crime No. 49 of 2022 registered at Umadi Police Station, Sangli for the offences punishable under Sections 302, 307, 341, 143, 147, 148, 149 and 506 of the Indian Penal Code and Section 4 read with 25 of the Arms Act and Section 135 of the Maharashtra Police Act on furnishing P.R.Bond in the sum of Rs.25,000/- with one or two sureties in the like amount.

The applicant shall attend the concerned police station once in a month, i.e., on first Saturday between 11.00 a.m. to 2.00 p.m. till conclusion of the trial. (N.R. BORKAR, J.) Dinesh S. Sherla 2/2
