Challenge in these writ petitions is to an order passed by the Deputy Charity Commissioner, Kolhapur Region, Kolhapur condoning delay in filing change report.

On perusal of the record, it appears that in a meeting dated 22 November 2009 certain subjects were transacted. The said subjects were confirmed in meeting dated 18 April 2010. The charge report was, thereafter, filed in the year 2011 along with application for condonation of delay contending that the Secretary of the trust died on 3 July 2010 which resulted in delay in filing the change report.

The Deputy Charity Commissioner, by the impugned order, condoned the delay considering the facts of the case and on being satisfied about the sufficiency of cause subject to costs of Rs.500/- 4.
Considering the reasons assigned in the report, in my opinion, the positive exercise of discretion by the Deputy Charity Commissioner does not appear to be perverse. Hence, no interference is called for.

The writ petitions are, therefore, dismissed. No costs. 6.
Pending interlocutory application(s), if any, stand disposed of.
