By this application, applicant is seeking bail in crime No. 46 of 2025 registered with Shirval Police Station, Satara for the offences punishable under Sections 109, 352, 351(2) and 3(5) of Bharatiya Nyaya Sanhita, 2023.

It is prosecution's case that on 22nd February, 2025 at around 7.30 p.m., the applicant and co-accused assaulted the first informant with sickle with intention to kill him on the ground of delivery of Banana Carat.

It is the contention of learned counsel for the applicant thatthe applicant is behind bar more than 6 months. 1/3

Investigation is completed. Charge-sheet has been filed. Applicant is 18 years old. He has no antecedents. Hence, requested to allow the application.

It is contention of learned APP that the applicant and coaccused assaulted the first informant with sickle with intention to kill him. If the applicant is released on bail, he may abscond or threaten the prosecution witnesses. Hence, requested to reject the application.

I have heard both learned counsel, perused the FIR and documents produced on record.

It appears from the record that investigation is completed and chargesheet has been filed. Applicant is behind bar more than 6 months. He is 18 years old. He has no antecedents. Considering these facts, further detention of applicant is not required and I pass following order:

ORDER

(i) Application is allowed.

(ii) The applicant be enlarged on bail in Crime No.46 of 2025 registered with Shirval Police Station, Satara, on executing P. R. Bond in the sum of 2/3

Rs.20,000/- with one or two sureties in the like amount.

(iii) The applicant shall attend the Court dates regularly.

(iv) The applicant shall not tamper with the evidence or attempt to influence or contact the complainant, witnesses or any person concerned with the case.

The application is allowed in the aforesaid terms and is accordingly disposed off.

It is made clear that the above observations are made only for the purpose of granting bail and the Trial Court shall decide the case on its own merits in accordance with law and uninfluenced by the observations made in this order. 9.
