Heard Shri Ritesh Thobde, the learned counsel for the applicant. It is submitted that the case was of consent, and the evidence clearly indicated the victim to be a consenting party. It is submitted that there was no satisfactory evidence to show that the victim was indeed of 15 years, as claimed by the prosecution. avk 1/2

904-APPA-1420-2014.doc After considering the matter from all the angles, when it was expressed that the appeal itself can be expeditiously heard, the learned counsel submitted that, in that case, he would not press the present application for suspension of sentence. The application for suspension of sentence is allowed to be withdrawn and stands disposed of.

The appeal is fixed for Final Hearing on 9th October 2015.
