This is an application for anticipatory bail in C.R. No.674 of 2022 registered with Karmala Police Station, Dist. Solapur Rural for the offences punishable under Sections 420, 465, 466, 467, 468 & 471 of Indian Penal Code.

The case of the prosecution is that the applicant had represented the complainant that he intends to sell his plot of land. He accepted the amount of Rs.80,000/- in cash. He also appeared before the office of Sub-Registrar, Karmala. However, it was noticed that the document i.e. Village Extract No.8 submitted by the applicant was fabricated. Hence, the FIR was registered. by SAJAKALI LIYAKAT JAMADAR Date:

Learned Advocate for the applicant submitted that the applicant is aged about 72 years. He is willing to cooperate with the investigation. Custodial interrogation of the applicant is not necessary. To show his bonafide he is willing to deposit the amount of Rs.80,000/-. He will provide specimen of his handwriting for the purpose of investigation. Section 467 of IPC is not applicable. 4.

Learned APP and learned Advocate for complainant submitted that the applicant is involved in forgery of government document. The offence is of serious nature. Huge amount was accepted by him. False representation was made by the accused to the complainant. His custodial interrogation is necessary. 5.

Considering the nature of allegations, the statement that the applicant would deposit an amount of Rs.80,000/- to show his bonafide and the age of the applicant, relief can be granted to the applicant.

ORDER

i.

Anticipatory Bail Application No. 2774 of 2022 is allowed;

ii.

In the event of arrest of the applicant in connection with C.R. No. 674 of 2022 registered with Karmala Police Station, Dist. Solapur (Rural) the applicant be released on bail on furnishing P. R. Bond in the sum of Rs.20,000/- with one or more sureties in the like amount;

iii.

The applicant shall deposit the amount of Rs.80,000/- in this Court within two weeks from the date of uploading this order.

iv.

The said amount shall be transferred to the trial Court as and when the charge-sheet is filed and the trial Court shall deal with said amount at appropriate stage.

v.
