Learned Counsel for the Petitioner invited our attention to the reliefs prayed in this petition and submitted that amount of pension has been wrongly disbursed in favour of Respondent No.5. It is submitted that it is the Petitioner who is entitled to the pensionary beneits of her deceased husband.

On perusal of petition, we are of the opinion that appropriate course for the Petitioner is to approach the Maharashtra Administrative Tribunal in terms of the provisions of the Administrative Tribunals Act, 1985.

Therefore, keeping all contentions of Petitioner open, petition is disposed of with liberty to the Petitioner to approach the Maharashtra Administrative Tribunal.
