By this application, applicant is seeking regular bail in C.R. IRESH MASHAL No. 178 of 2024 registered with Natepute Police Station, District Digitally signed by IRESH MASHAL Date:

2025.11.12 18:18:05 +0530 Solapur for offences punishable under Sections 302, 324, 323, 504, 506, 143, 147, 148, 149 of the Indian Penal Code of read with 135 of the Indian Penal Code.

It is the prosecution's case that on 17th May 2024, applicant and co-accused assaulted the deceased to death on the ground of old dispute.

It is contention of learned counsel for applicant that coaccused Gorakh Vilas Bodre, having the same allegations like the applicant has been released on bail by this Court. Hence, requested to

allow the bail application on principle of parity. 4.

It is the contention of learned APP that applicant is not entitled for parity as the allegations against the applicant are on different footing than co-accused Gorakh Bodre. Learned APP further submitted that applicant has one antecedent under Section 302 of the Indian Penal Code. Hence, requested to reject the application. 5.

I have heard both learned counsel, perused F.I.R. and documents produced on record. The co-accused Gorakh Bodre, having the same allegations like the applicant has been released on bail by this Court. Considering these facts, the applicant is entitled to bail on principle of parity and I pass following order:

O R D E R

I.

The Application is allowed.

II.

The Applicant be enlarged on bail in C.R. No. 178 of 2024 registered with Natepute Police Station, District Solapur on executing P.R.Bond in the sum of Rs. 20,000/- with one or two sureties in the like amount.

III.

The Applicant shall not tamper with the evidence or attempt to influence or contact the witnesses or any person concerned with the case.

IV.

The Applicant shall attend the Trial Court dates regularly. V.

The application is allowed in the aforesaid terms and is accordingly disposed off.

VI.

It is made clear that the above observations are made only for the purpose of granting bail and the Trial Court shall decide the case on its own merits in accordance with law and uninfluenced by the observations made in this order. 6.
