IN THE HIGH COURT OF JUDICATURE AT BOMBAY
CIVIL APPELLATE JURISDICTION Amk WRIT PETITION NO. 11163 OF 2019 Subhash Ramchandra Kadam & Ors.
.. Petitioners Vs.
State of Maharashtra & Ors.
.. Respondents Mr. Kalpesh U. Patil for the Petitioners.
Mr. K. S. Thorat, AGP for Respondent Nos.1 to 4. CORAM : PRADEEP NANDRAJOG, C.J. & SMT. BHARATI DANGRE, J.
DATE : 10 th DECEMBER, 2019.
P. C. :
1.
Limited grievance of the Petitioners is that in the absence of the Revenue Department in the State of Maharashtra being allocated to any Hon'ble Minister, Revision Application No. 10578/2019 along with application seeking interim relief is not being considered and in the meanwhile the order impugned in the Revision is being enforced against the Writ Petitioners.
2.
Learned Counsel for the Respondents states that as per Maharashtra Government Rules of Business, 1975 in the absence of a Minister in charge of the Revenue Department, the Secretary, Revenue can exercise revisional powers.
3.
Thus, we dispose of the Writ Petition directing that Revision Application No. 10578/2019 filed by the Writ Petitioners be considered expeditiously either by the Hon'ble Minister of Revenue or by the 1/2
(902) WP 11163-19 Secretary, Department of Revenue and till the application for interim relief is considered, status-quo as of 18.11.2019 be maintained. [SMT. BHARATI DANGRE, J.] [CHIEF JUSTICE] by Arjun M.
