Writ Petition Nos. 9386 of 2021 and 9387 of 2021 are filed by the State and Writ Petition (Stamp) Nos. 17539 of 2021 and 17540 of 2021 are filed by the private Respondents in the Original Applications.
The Respondents/Original Applicants had filed their respective applications before the Maharashtra Administrative Tribunal challenging their order of transfer. The Tribunal by the
R.V.Patil 3 15 WP.9386.2021.doc common impugned order dated 10 August 2021 set aside the order of transfer and directed that the Respondents/Original Applicants be re-posted on the post from where they were transferred. The further directions regarding posting of the Petitioners in Writ Petition (Stamp) Nos. 17539 of 2021 and 17540 of 2021, who were private respondents in the Original Applications, were also issued. This order has been challenged in these four petitions. The learned Counsel appearing for the Respondents/Original Applicants states that even though the order of transfer was quashed and set aside, there was an interim stay in these petitions and thereafter the Respondent/Original Applicants have been re-posted to another transfer posting and they have accepted those transfers. Statement is accepted. In view of these changed circumstances, the cause for filing these petitions does not survive. The writ petitions are accordingly disposed of.
If the subsequent developments are prejudicial to any party, it is open to the parties to approach the Tribunal which is the Court of first instance.
