Heard Mr. Deshmukh, learned Counsel appearing for the Applicant and Mrs. Mhatre, learned APP for the State. 2.

The application is for seeking direction to release the Applicant on bail.

The Applicant is original accused No.19 and Respondent No.17 in above appeal. The said appeal is against the order of acquittal. Appeal is pending for final hearing. In the said appeal, the Applicant is represented by Advocate Mr. Milind Deshmukh.

Above appeal as well as connected appeal, being Appeal No.712 of 2003 came up for final hearing before the Court on 31st July 2015 [Coram : B. P. Dharmadhakari & A. S. Gadkari, JJ.]. This Court directed the trial Court to issue non-bailable warrants for the appearance of accused persons 11, 16, 17, 20 and 22 before this Court. The Applicant was present before this Court on 31st July 2015 through his Advocate and this Court has recorded his appearance in paragraph No.2.

Non-bailable warrant could not have been issued against Respondent No. 17 (Accused No. 19). But only because of typographical error in the order dated 31st July 2015, accused came to be arrested.

In the circumstances, the Applicant is directed to be released on bail on his furnishing PR bond of Rs.10,000/-. 7.

All concerned shall act upon an authenticated copy of this order.
