IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CRIMINAL APPELLATE JURISDICTION BAIL APPLICATION NO.2437 OF 2018 Shri. Niranjan Malhari Gujale ....

Applicant Vs.

The State of Maharashtra ....

Respondent Mr. Girish R. Agrawal for the Applicant.

Ms. P.P. Shinde, APP for the State.

Mr. M.D. Sapkal, Havildar, Karad Taluka PS present. Coram : Smt. Sadhana S. Jadhav, J.

Date : 26th October 2018 P.C.:

Heard the learned counsel for the applicant.

This is a subsequent application seeking enlargement on bail. On 18th November 2016, the previous application was withdrawn before this Court as this Court was not inclined to grant bail. This Court had requested the learned Sessions Judge, Karad to make an endeavour to conclude the recording of evidence as far as possible within nine months from the date of framing of charge. The charge is framed on 15th January 2018.

Dusane 2/2 903 ba 2437.2018.doc Learned APP, upon instructions, submits that in the present case, two witnesses have been examined i.e. both the panchas have been examined. In view of this once recording of evidence is commenced, it would not be appropriate to consider an application seeking enlargement of bail. Hence, the application stands rejected.

The learned Sessions Judge, Karad shall make every endeavour to conclude the recording of evidence by 31st December 2018.
