This Court is informed that the matter has been settled between petitioner and respondent Nos.3 and 5 i.e. the Trust and the School. Consent Terms are tendered on record and marked "X" for identification. The Consent Terms are signed by the petitioner and the Chairman of the Trust and Headmaster of respondent No.5 and also by their respective advocates. Copy of resolution of respondent 3 is annexed to the Consent Terms. The parties are present in Court and reiterate the terms of the Consent Terms.

As far as clauses (iii) and (iv) of the Consent Terms are concerned, the proposal will be submitted by respondent Nos. 3 and 4 rsk 1 of

21-WP-10557-09.doc to the Education Officer, who will decide the same in accordance with law. It is made clear that the acceptance of the Consent Terms does not amount to a direction to the Educational Officer to decide the proposal in any particular manner and the Educational Officer to decide the same on its own merits and in accordance with law. The undertakings given by the petitioner and respondent Nos.3 and 5 are accepted as undertakings given to this Court. 3.

Petition stands disposed of in terms of the Consent Terms. In view of disposal of petition, Interim/Civil Applications, if any, do not survive for consideration and stand disposed of. [Sharmila U. Deshmukh, J.] rsk 2 of
