The proposal was submitted seeking approval to the appointment of the Petitioner No.3 as an Assistant Teacher on unaided post. The proposal has been returned back on the ground that the certain clarifications were not given. 2.

Mr.Prashant Bhavake, the learned counsel for the Petitioner submits that the Education Officer ought to have given some opportunity to the Petitioner to explain the same. 3.

Considering the fact that the proposal has been returned back by the Education Officer, the Management shall resubmit the proposal to the Education Officer seeking approval to the appointment of the Petitioner No.3 and may give necessary clarification as is sought in the communication returning back the proposal. The Education Officer shall thereafter decide the said proposal afresh on its own merits within a period of four months from the receipt of the fresh proposal. 5.

Writ Petition is disposed of. No costs.
