Heard. In the present proceedings, Respondent No.1 NABARD has filed Affidavit-in-Reply dated 21.10.2018 stating that the Agricultural Debt Waiver and Debt Relief Scheme 2008 has already been closed and they do not have any funds under the said scheme. In view of the said affidavit, this court declined to entertain the Writ Petition.

At this stage, the learned counsel for the Petitioner seeks liberty to withdraw the Writ Petition with liberty to file afresh on the same cause of action against the Union of India. To that effect, he has given in writing. Same is taken on record and marked "X" for identification.
