The challenge in this petition is to the order dated 15/3/2018 passed by the District Deputy Registrar fixing the upset price of the property belonging to the petitioner which order has been confirmed by the fifth respondent Divisional Joint Registrar on 3/9/2018. 2.
Learned counsel for the respondent Nos.1 and 2 in all fairness states that the validity of the order fixing the upset price is for six months which period has already expired. He submits that in such circumstances, the respondent Nos.1 and 2 will have to take steps for fixing of the upset price afresh.

In that view of the matter, nothing survives in the petition which is accordingly disposed of, as infructuous, with no order as to costs.

Learned counsel for the petitioner submits that the petitioner is ready and willing to settle the dispute amicably and a proposal to that effect shall be made to the first respondent credit society. 5.
Needless to mention that if such proposal is made, it will be open to the first respondent to consider the same, on its own merits and as per the applicable provisions.

In view of the disposal of the petition, the Civil Application No.2174/2018 is also disposed of as infructuous. C.V. BHADANG, J.
