By this application, applicant is seeking regular bail in Crime No. 382 of 2024 registered with Ichalkaranji Police Station, District, Kolhapur for offence punishable under Sections 420, 407, 409, 465, 467, 468, 471 read with 34 of the Indian Penal Code.

It is the prosecution's case that during 3/10/2022 to 27/03/2024, applicant and co-accused prepared false vouchers and misappropriated the amount of Rs. 13,41,71,866/-. 3.

It is contention of learned counsel for applicant that The 1/3

allegations against the applicant are of misappropriation of property of around Rs. 23 Lakhs. The co-accused having same allegations have been released on bail by this Court after depositing the misappropriated amount by them. The applicant has given demand drafts of Rs. 19,00,000/- i.e. Rs. 9,50,000/- each. Hence, requested to allow the application. 4.

Learned APP strongly objected to bail on the ground that the applicant was involved in misappropriation of property. If he is released on bail, he may abscond or threaten prosecution witnesses and requested to reject the application. 5.

I have heard both learned counsels, perused F.I.R. and documents produced on record. The co-accused Shreyas Mane and Yash Jadhav against whom, similar allegations are levelled have been released on bail after depositing misappropriated amount.

As the applicant has deposited DD of Rs. 19 Lakhs, I pass following order:

O R D E R

I.

The Application is allowed.

II.

The Applicant be enlarged on bail in Crime No. 382 of 2024 registered with Ichalkaranji Police Station, District, Kolhapur on executing P.R.Bond in the sum of Rs. 20,000/- with one or two sureties in the like amount.

III.

The Applicant shall not tamper with the evidence or attempt to influence or contact the witnesses or any person concerned with the case.

IV.

The Applicant shall attend the Trial Court dates, regularly.

The application is allowed in the aforesaid terms and is accordingly disposed off.

It is made clear that the above observations are made only for the purpose of granting bail and the Trial Court shall decide the case on its own merits in accordance with law and uninfluenced by the observations made in this order. 9.
