By an Order dated 27.9.2018 the applicant was granted interim relief. Heard the learned counsel appearing for the applicant, the learned APP. and the learned counsel for the Intervener. Perused the-record. 2.
The record clearly indicates that, all the material and relevant allegations of threats and extortion are revolving against the principal Page1/2
Nalawade 24-aba-1992-18.doc accused Abhay Bandgar. It is the allegation against the applicants that, the applicants accompanied Abhay Bandgar on 3.7.2018 to the school when principal accused Abhay Bandgar extended threats for extortion. The record prima facie indicates that, the applicants have no major role to play in the present crime. The record further indicates that, in pursuance of the directions issued by this Court on 27.9.2018 the applicants have attended the Investigating Officer and have co-operated in the process of investigation. 3.
After taking into consideration the facts of the present case, this Court is of the view that, custodial interrogation of the applicants for further investigation of the present crime is not necessary. 4.
In view of the above, the interim relief granted by Order dated 27.9.2018 is confirmed. However, the condition to attend the Investigating officer is hereby waived.
