Heard learned counsel for the applicant, learned APP for the State and learned counsel Ms. Priyanka H. Chavan, who was requested by this Court to appear on behalf of the respondent no.2 as there was no appearance on behalf of the respondent no.2 though she was duly served. 2.
This is an application for suspension of sentence. The maximum sentence for the offence punishable under Section 354-A of the Indian Penal Code read with Section 11 read with Section 12 of the Protection of Children from Sexual Offences Act, 2012 imposed by the trial Court is 1 1/2
Diksha Rane 908. ia 348723.doc year rigorous imprisonment. The fine amount has been paid. 3.
I have perused the judgment and order of the conviction passed by the trial Court. Considering that the appeal is not likely to be heard soon and that the sentence being short, I am inclined to suspend the sentence during the pendency of this appeal. The sentence is so suspended. The applicant be enlarged on same bail as before the trial Court with fresh bonds.
