The Applicant is apprehending arrest in Crime No.259 of 2025 registered with Karmala Police Station, Solapur, for the offences punishable under Sections 115(2), 118(1), 119(1), 189, 190, 191, 351(2), 352 of the Bharatiya Nyaya Sanhita, 2023 (for short, "BNS Act").

It is prosecution's case that on 2nd April, 2025, the Applicant and co-accused assaulted the first informant and his friend with belt and wooden stick with intention to kill them. Shantanu S. Dhudum 1/3

It is contention of learned counsel for the Applicant that the main allegations are against the co-accused. The allegations against the Applicant are that he assaulted the first informant with belt and wooden stick. When the Applicant was on interim relief, he cooperated with the investigation. The investigation is almost completed. Hence, requested to allow the application. 4.

It is contention of learned APP that the Applicant and coaccused assaulted the first informant and his friend with axe and wooden stick as well as fist & kick blows. The co-accused had snatched the gold chain of the first informant. Considering allegations against the Applicant, his custodial interrogation is required, and requested to reject the application.

I have heard both learned counsel, perused the document produced on record.

The allegations against the Applicant are of assaulting the first informant and his friend with belt and wooden stick. The main allegations are against the co-accused. The Applicant was on interim relief, he has co-operated with the investigation. The investigation is almost completed. Considering these facts, I pass following order: Shantanu S. Dhudum 2/3

ORDER

i. The application is allowed.

ii. Interim protection order dated 8th October, 2025 passed by this Court is made absolute.

The application is allowed in the aforesaid terms and is accordingly disposed off.

It is made clear that the above observations are made only for the purpose of granting bail and the Trial Court shall decide the case on its own merits in accordance with law and uninfluenced by the observations made in this order.
