By this petition preferred under Article 226 of the Constitution of India, the petitioner seeks direction to the respondents to issue degree of 10th, 12th, Graduation and Disability Certificate by correcting Date of Birth as "24th May, 1998" as per Birth Certificate instead of "19th June, 1998". 2.

Learned Counsel for the petitioner submitted that an application for correction of Date of Birth has not been made in writing to the concerned Authorities. It is pointed out that there are various documents indicating correct Date of Birth and, therefore, the Date of Birth deserves to be corrected as "24th May, 1998".

Prima facie, we find substance in the contention of the petitioner that School Leaving Certificate which is at page 16 of the petition correctly records the Date of Birth as "24th May, 1998".

In our opinion, it would be appropriate in the present facts that the petitioner shall make an application to the respondents to correct his Date of Birth as per the Birth Certificate. In such view of the matter, there is no doubt that if a request is made to the respondents for correction of Date of Birth in the necessary certificates, the same shall be considered by the respondents positively.

If an application/representation is made by the petitioner to the respondents for correction of Date of Birth on the basis of Date of Birth recorded in the Birth Certificate, the same shall be considered by the respondents expeditiously and, in any case, necessary decision for correction of Date of Birth shall be taken within a period of four weeks from the date of receipt of the application/s.
