This is an application for condonation of delay in filing the appeal against the judgment of conviction passed by learned Additional Sessions Judge, Barshi, District Solapur in Sessions Case No.63 of 2021 on 5th March, 2025 by which the applicant was convicted under sections 302, 201 and 120B r/w section 34 of the Indian Penal Code, 1860. 2.

Ms. Veera Shinde, learned A.P.P opposed the application by contending that delay is not properly explained.

However, for the reasons mentioned in paragraph 6 of the application, we are satisfied that delay of 123 days in filing the appeal needs to be condoned and hence condoned. Application is allowed in terms of prayer clause (a). 4.
