Heard learned counsel for the Applicant and learned APP for the Respondent - State.

By this application, the Applicant is seeking relaxation of condition imposed by this Court (Coram: Anil S. Kilor, J.) vide order dated 8th July, 2024. By the said order, the condition No.(iii) imposed on the Applicant that the Applicant shall not enter into the territorial jurisdiction of Sangli City, till the conclusion of the trial, except on the date of trial.

It is contention of learned counsel for the Applicant that the Applicant's mother is suffering from various heart ailments and he needs to take care of her. Hence requested to allow the application and relax the said condition.

It is contention of learned APP that the Applicant is charged with offence punishable under Section 302 of IPC and other sections. If the condition is relaxed, he may threaten the prosecution witnesses, and requested to reject the application.

I have heard both learned counsel, perused the impugned order.

The trial has started and eight witnesses have been examined. The Applicant wants to take care of his sick and aged mother. Considering these facts, I pass following order:

ORDER

i. The application is allowed.

ii. The bail condition No.(iii) vide order dated 8th July, 2024 is modified as under:

". The Applicant shall enter in the jurisdiction of the Vishrambag Police Station only."

iii. The Applicant shall not contact with the prosecution witnesses.

The application is allowed in the aforesaid terms and is accordingly disposed off.
