By this Civil Application, Applicant is seeking condonation of 165 days delay in filing First Appeal challenging the judgment and award dated 13.1.2010 passed by Civil Judge, Senior Division, Baramati in L.A.R. No.439 of 2002.

50 caf1849-17.doc Considering the submissions made by the learned A.G.P. for the Applicant and the averments made in the Application, I am satisfied that the Applicant has made out a case for allowing the present Civil Application. Hence, following order:

A) Civil Application is allowed in terms of prayer clause (b) which reads thus.:

"(b) that this Hon'ble Court be pleased to condone 165 days delay in filing above mentioned First Appeal against the Judgment and Award dated 13.01.2010 passed by the Learned Civil Judge, Senior Division, Barshi, Solapur in L.AR..No.439 of 2002."

B) Civil application stands disposed off accordingly.
