Heard learned AGP for applicant.

By this Civil Application, applicant is seeking stay of the operation and implementation of the impugned judgment and award dated 13.01.2010 passed by Reference Court in Land Acquisition Reference No.439 of 2002 awarding the additional compensation of Rs.49,500/- in respect of the acquired land. This Court by order dated 24.01.2018 directed applicant to deposit the entire amount of 1/3

compensation along with interest.

Considering these facts, at the request of learned AGP, following order is passed :- a) Applicant to deposit the entire awarded amount in Reference Court on or before 30.04.2019, if it is not deposited as per earlier order, failing which Civil Application shall stand dismissed without reference to the Court.

b) If amount is deposited within time, as stated above, the Reference Court is directed to invest the said amount in a fixed deposit account of any Nationalized Bank, initially for a period of one year and same shall be continued till further orders.

c) Liberty granted to the respondent/original claimant to prefer 2/3

appropriate application for withdrawal of the awarded amount which will be decided on its own merits.

d) Civil Application stands disposed of accordingly.

e) No order as to costs.
