Heard learned Counsel for the petitioner.

Learned Counsel for the petitioner has prayed for the following substantive reliefs:

[A] That this Honourable Court be pleased to issue writ mandamus or writ in nature of mandamus or any other writ or direction thereby be pleased to direct the Respondents not to erect/install and not to take the further steps for installation / erection of the statue of Bharatratna Dr. Babasaheb Ambedkar in Jaysingpur Maharaj Garden. (C.S. No.1255), Jaisinghpur Taluka Shirol, District Kolhapur and be pleased to quash and set aside all the permissions if any and resolutions passed by the Respondents for installation /erection of the statue of Bharatratna Dr. Babasaheb Ambedkar in Jaysingpur Maharaj Garden.

B] That this Honourable Court be pleased to issue Writ of mandamus or writ in nature of mandamus or any other writ or direction thereby be pleased to direct the Respondents to install the comprehensive plan of having museum, library, UPSC and MPSC preparation centre and statue of Dr. Babasaheb Ambedkar in CTS No.1251 Jaisinghpur Taluka: Shirol Dist: Kolhapur by follong the due process mentioned in Government Resolution dated 2nd May, 2017.

Learned Counsel for the Respondent No.1-Nagar Parishd, pointed out that decision to install the statue is not yet taken. Learned Counsel for the petitioner was at pains to point out that the decision making process is not in accordance with the Government Resolution dated 2nd May, 2017 which is at page No.51 of the paper book, which provides for the guidelines while installing the statue.

As the decision to install the statue is not yet taken, in our opinion, the present petition is premature. If at all the petitioner wants to challenge the decision making process, the same can be done after the decision is taken.

Without expressing any opinion on the merits of the contention and liberty of the petitioners to challenge the final decision if the same is contrary to the Government Resolution dated 2nd May, 2017 is kept open.

The petition is disposed of.

In view of the disposal of the writ petition, the interim application also stands disposed of.
