By this application, applicant is seeking regular bail in Crime No.34 of 2024 registered with Mahatma Gandhi Chowk Police Station, Miraj District-Sangli for the offences punishable under Sections 376, 376(D), 370, 366, 392, 342, 506 r/w Section 34 of the Indian Penal Code, 1860 and under Sections 3(A), 4, 5(g)(l) and 6 of Protection of Children From Sexual Offences Act, 2012. 2.

It is prosecution's case that the applicant had sold the victim to the co-accused for Rs.4 lakhs. At the time of incident, the victim was minor.

It is contention of learned counsel for the applicant that the coaccused Sarfaraz against whom similar allegations like the applicant, has been released on bail by this Court. The applicant is a lady. She is behind bar more than 1 year. It may take time to conclude the trial. Hence, requested to allow the application.

It is contention of learned APP along with respondent no.2 that the applicant and co-accused sold the victim to the co-accused Bratesh, who performed marriage with the victim, for Rs. 4 lakhs. At the time of incident, the victim was minor. It shows the active involvement of the applicant in the crime. Hence, requested to reject the application.

I have heard both learned counsels, perused the FIR and documents produced on record.

Admittedly, the applicant is behind bar more than 1 year. The applicant is a lady. It may take time to conclude the trial. The coaccused against whom having similar allegations like the applicant, has been released on bail by this Court. Considering this fact, the applicant is entitled for bill on principle of parity and I pass following order :

ORDER

I.

Application is allowed;

II.

The applicant be enlarged on bail in Crime No.34 of 2024 registered with Mahatma Gandhi Chowk Police Station, Miraj District-Sangli, on executing P.R.Bond in the sum of Rs.20,000/- with one or two sureties in the like amount.

III. The applicant shall not tamper with the evidence or attempt to influence or contact the victim, witnesses or any person concerned with the case.

The application is allowed in the aforesaid terms and is accordingly disposed off.

It is made clear that the above observations are made only for the purpose of granting bail and the Trial Court shall decide the case on its own merits in accordance with law and uninfluenced by the observations made in this order.
