By this application, applicant is seeking regular bail in Digitally signed by IRESH MASHAL Date:

2025.11.07 10:06:14 +0530 Crime No. 465 of 2022 registered with Pandharpur Taluka Police Station, District Solapur for offences punishable under Sections 302, 120B read with 34 of the Indian Penal Code.

It is the prosecution's case that on 12th July 2022, between 8.45 hours to 9.30 hours, when the first informant and his son were proceeding on road on their motorcycle, at that time, the applicant and co-accused dashed their motorcycle by car and murdered the son of the first informant on the ground of old dispute. 3.

It is the contention of learned counsel for applicant that the

co-accused against whom similar allegations are levelled have been released on bail. Hence, the applicant is entitled to bail on principle of parity.

It is the contention of learned APP that applicant is the main conspirator and participated in the offence. If applicant is released on bail, he may threaten the prosecution witnesses. Hence, requested to reject the application.

I have heard both learned counsel, perused F.I.R. and documents produced on record. The co-accused against whom similar allegations are levelled have been released on bail. Hence, the applicant is entitled to bail on principle of parity. 6.

In view of above, I pass following order:

O R D E R

I.

The Application is allowed.

II.

The Applicant be enlarged on bail in Crime No. 465 of 2022 registered with Pandharpur Taluka Police Station, District Solapur on executing P.R.Bond in the sum of Rs. 20,000/- with one or two sureties in the like amount.

III. The Applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case, as also

not tamper with evidence.

IV.

It is made clear that the above observations are made only for the purpose of granting bail and the Trial Court shall decide the case on its own merits in accordance with law and uninfluenced by the observations made in this order.

The application is allowed in the aforesaid terms and is accordingly disposed off.
