Mr. Shivaji Jagadale, learned Counsel for the Petitioners would invite the attention of this Court to the order dated 21st June, 2024 in Writ Petition No.3511 of 2015 and Writ Petition No.7227 of 2016 passed by this Court, pointing out the paragraph No.7 of the said order. Learned Counsel for the Petitioners would submit that the Secretary of the Education Department was under
12-cp-560-2025.doc obligation to take necessary decision within eight weeks as regards to the situation that was beyond the control of both the Petitioners who had shown their willingness to work during crucial period. 2.
He would further submit that despite of these directions, the concerned authority i.e. the Secretary of the School Education Department has not taken the decision yet and hence it is inaction on the part of such authority, falls under the ambit of Contempt of Courts Act, 1971.

Mr. Kalel, would submit that he would contact the concerned authority and would appraise this Court on the next date as to whether the said authority has taken the decision pursuant to the order passed by this Court or not.

In the mean time, it is expected that the concerned Authority would take appropriate decision on its own merit and particularly in the light of the view expressed by this Court while passing the order dated 21st June, 2024.

Mr. Kalel, learned AGP for the State submit that in any event, the Secretary of the School Education Department would take such decision within a period of four weeks from today and such decision would be informed to the petitioners accordingly. 6.
In view of the said statement, both the contempt petition proceedings are disposed by keeping all issues open to the parties to be agitated. Liberty accordingly.
