Heard the learned counsel for the Petitioners and learned counsel for Respondents.

Learned counsel for Respondents on instructions submits that the Petitioners are dragging the D.V. proceedings pending before the learned trial Court on one and the other pretext. If the Petitioners are ready to finish the cross examination of the Respondents, the respondents will deposit arrears of maintenance amount of Rs.1,50,000/- as due on September-2024 within 15 days. The learned counsel further submits that it is observations of the trial by SAJAKALI LIYAKAT JAMADAR Date:

Court that Petitioners are dragging the D.V. proceedings on one and other pretext. If this Court directs the trial Court to dispose off the D.V. proceedings filed by the Petitioners within six months preferably on day to day basis would suffice.

Learned counsel for the Petitioners on instructions submit that the Writ Petition be disposed off in view of the submission of learned counsel for Respondents. The Petitioners undertake to cross examine the Respondents within two weeks after depositing of arrears of maintenance amount of Rs.1,50,000/-. Learned counsel further submits that the Petitioners would not take adjournment before the trial Court and shall co-operate to the trial Court to dispose off the D.V. proceedings within six months.

Considering the submissions of both learned counsels, I pass the following order.

ORDER

(i) The Writ Petition is allowed and disposed off; (ii) The impugned orders dated 19.07.2025, 19.08.2025 and 01.09.2025 passed below Exhibits 90, 111 and 113 are quashed and set aside.

(iii) The Petitioners be permitted to cross examine the Respondents.

(iv) The Petitioners shall finish the cross examination of the Respondents within two weeks after depositing the arrears of maintenance amount of Rs.1,50,000/-.

(v) The trial Court is requested to dispose off the pending D.V. proceedings as early as possible preferably within three months after receipt of this order.
