By this application, applicant seeks an extension of time to institute suit and for consequential compliance in terms of order dated 16th July 2024.

This Court, while considering question regarding validity of mutation entry recording the names of State authorities, granted liberty in favour of petitioners to file an appropriate civil suit in the Court having Principal Original Jurisdiction and agitate their substantial right of entitlement to subject properties. It was further directed that civil suit shall be instituted within a period of eight weeks from date of order along with application below Exhibit-5,
36-IA - 11034 - 2025 .doc and Civil Court was directed to take cognizance of such application and determine same within a period of four weeks from its presentation, in accordance with law.

Having considered the submissions advanced, it can be observed that petitioners approached Supreme Court against order dated 16th July 2025, and consequently, timeline given in order could not be followed. It would be necessary in the interest of justice to grant an extension of period for institution of suit and for consequential orders to be passed by Civil Court. 4.
In that view of the matter, interim application is allowed. 5.
The petitioners are granted liberty to institute a suit within a period of eight weeks from today, along with application below Exhibit-5, and pray for appropriate interim relief therein. 6.
In case the suit along with application below Exhibit-5 is instituted, Trial Court to consider application for interim relief on its own merits within a period of four weeks from the date of its presentation.
