This is an application for anticipatory bail filed by the Applicant herein in apprehension of his arrest in Crime No.259 of 2015 registered with Vijapur Police Station, Dist. Solapur, for the offences punishable under sections 420, 467 and 468 of the I.P.C. 2.

Heard the learned counsel for the Applicant and the learned APP for the Respondent­State.

I have perused the records and considered the submissions advanced by the learned counsel for the respective parties. 1/3

The records prima facie reveal that the FIR dated 7th August, 2015 is in respect of the incident, which had allegedly occurred in the year 2007. The complaint reveals that the complainant had earlier filed complaint dated 11th September, 2014, the same was not investigated. Prima facie the gross delay in lodging the complaint would itself justify grant of anticipatory bail. The Applicant is a permanent resident of Vijapur and there is no possibility of the Applicant absconding or fleeing from the course of justice. Considering the above facts, the Applicant is entitled for anticipatory bail. 4.

Under the circumstances and in view of the discussion supra, the anticipatory bail application is allowed on the following terms and conditions :­ i) In the event of arrest of the Applicant in Crime No.259 of 2015 registered with Vijapur Police Station, Dist. Solapur, the Applicant be released on bail bond of Rs.25,000/­ (Rupees Twenty Five Thousand Only) with one or two sureties in the like amount to the satisfaction of Additional Sessions Judge, Solapur.

ii) The Applicant to report to the Investigating 2/3

Officer for seven days between 10.00 a.m. to 1.00 p.m. and further as and when required by the Investigating Officer for the purpose of investigation and interrogation.

iii) The Applicant shall cooperate in the investigation and shall not interfere and tamper with the evidence in any manner.
