Applicant is apprehending his arrest in C.R. No. 184 of 2025 registered with Dahiwadi Police Station, District: Satara for offences IRESH MASHAL punishable under Sections 74, 75, 351(2) of Bhartiya Nyaya Sanhita, by IRESH MASHAL Date:

2025.12.19 17:06:55 +0530 2023 read with Sections 8 and 12 of Protection of Children from Sexual Offences Act, 2012.

It is the prosecution's case that on 20th May 2025, the applicant outraged the modesty of the minor daughter of the first informant.

It is contention of learned counsel for applicant that the applicant has been falsely implicated in this case. While on interim

relief, the applicant has co-operated in the investigation. Investigation is almost completed. Hence, requested to allow the application. 4.

It is contention of learned APP alongwith learned counsel respondent no. 2 that applicant outraged the modesty of the minor daughter of the victim. The applicant stays in the same locality. Considering the allegations against the applicant, his custodial interrogation is required. Hence, requested to reject the application. 5.

I have heard all the learned counsel, perused F.I.R. and documents produced on record. While on interim relief, the applicant has co-operated in the investigation. Investigation is almost completed. Considering these facts, custodial interrogation of the applicant is not required.

In view of above, I pass following order:

O R D E R

I.

Application is allowed.

II.

In the event of arrest, applicant be enlarged on bail in C.R. No. 184 of 2025 registered with Dahiwadi Police Station, District: Satara on furnishing P.R. Bond in the sum of Rs. 20,000/- with one or two sureties in the like amount.

III.

The applicant shall attend the concerned police station as and when required.

IV.

The applicant shall not tamper with the evidence or attempt to influence or contact the complainant, witnesses or any person concerned with the case.

V.

The applicant shall not enter enter in the area where the victim stays and shall not contact the victim and her family members. VI.

Professional fees of Rs. 10,000/- to be paid to learned counsel appointed through Legal Aid for respondent no. 2. VII.

Application is disposed of in above terms.
