The Applicants are apprehending their arrest in Crime No.349 of 2025 registered with Kurduwadi Police Station, Dist. Solapur for the offences punishable under Sections 126(2), 127(2), 135, 304(2), 308(3), 309(4), 351(3) of the Bhartiya Nyaya Sanhita, 2023.

It is prosecution's case that the applicants had kidnapped Digitally signed by SAJAKALI LIYAKAT JAMADAR Date:

2025.11.28 18:16:13 +0530 the first informant, her husband, son as well her brother in Ertiga Car SAJAKALI LIYAKAT JAMADAR

and threatened them as well as assaulted them on the ground of old dispute. The offence was registered against the applicants on the order of Magistrate under Section 156(3) of Cr.P.C. 3.

It is contention of learned counsel for Applicants that the investigation is almost completed. While on interim relief, the applicants have cooperated in investigation. Considering the allegations against the applicants, their custodial interrogation is not required and hence, requested to allow the application. 4.

It is contention of learned APP that the applicants had kidnapped the first informant and her family members and threatened them and assaulted them on the ground of old dispute. They have taken cash amount amount and mobile phone from the first informant and her family members. Hence, requested to reject the application.

I have heard both the learned counsels, perused the FIR and documents placed on record. While on interim relief, the applicants have cooperated in investigation. Investigating is almost completed. Considering these facts, their custodial interrogation is not required. Hence, I pass the following order.

ORDER

(i) Application is allowed;

(ii) In the event of arrest, the Applicants be enlarged on bail in Crime No.349 of 2025 registered with Kurduwadi Police Station, Dist. Solapur on executing P.R.Bond in the sum of Rs.20,000/- each with one or two sureties in the like amount;

(iii) The applicants shall not enter into jurisdiction of Kurduwadi Police Station, till filing of charge-sheet. (iv) The Applicants shall attend the concerned police station as and when required.

The application is allowed in the aforesaid terms and is accordingly disposed off.

It is made clear that the above observations are made only for the purpose of granting anticipatory bail and the Trial Court shall decide the case on its own merits in accordance with law and uninfluenced by the observations made in this order. 8.
