The Applicant is apprehending arrest in Crime No.497 of 2025 registered with Barshi City Police Station, District: Solapur, for the offences punishable under Sections 3, 4, 5 and 6 of the Immoral Traffic (Prevention) Act, 1956 (for short, "PITA") and Sections 143(2), 144(2), 3(5), 111(2)(B), (3), (4) of the Bharatiya Nyaya Sanhita, 2023 (for short, "BNS Act").

It is prosecution's case that on 8th June, 2025 on secret information police raided at one house where the prostitution was going on. It is alleged that the said house belongs to the Applicant. 3.

It is contention of learned counsel for the Applicant that the Shantanu S. Dhudum 1/3

Applicant has been falsely implicated in this case. All the victims were major. The police have recorded the statement of all the victims. They have not taken the name of the Applicant. The co-accused were conducting the said business, and they have been released on bail hence, the Applicant is entitled for bail on principle of parity, and requested to allow the application.

It is contention of learned APP that the Applicant is owner of the house where the prostitution was going on. He was running the the prostitution business and forced victims to do the prostitution. Considering allegations against the Applicant, his custodial interrogation is required, and requested to reject the application. 5.

I have heard both leaned counsel, perused F.I.R. and documents produced on record.

At the time of incident, the Applicant was not present in the house where the prostitution was going on. It is alleged that said house belongs to the Applicant. To prove the nexus of the Applicant with present crime evidence is required. Considering allegations against the Applicant, his custodial interrogation is not required, and I pass following order:

ORDER

i. The Application is allowed.

ii. In the event of arrest, the Applicant be enlarged on bail in connection with C.R. No.497 of 2025 registered with Barshi City Police Station, District: Solapur, on executing P. R. Bond to the extent of Rs.20,000/- with one or two sureties in the like amount.

iii. The Applicant shall attend the concerned police station as and when required.

iv. The trial Court shall not be influenced by the observations made in this order and shall decide the matter on its own merits and in accordance with law.

In view of the above, the application is allowed and disposed off.
