By order dated 18th September 2025, Mr. Madhav Yashwant Pethe was appointed as the mediator. However, it is contended on behalf of applicant that appointed mediator has a very close association with Respondent No. 1 - Society, which creates a reasonable apprehension of bias and partiality in mediation process.

Although this Court is not inclined to accept such allegations against appointed mediator, who has yet to commence mediation work, in order to avoid further complications, Mr. Vinod

501-ia11062-2025.doc Wamanrao Andraskar, Special Auditor Class-2, Co-op. Societies (Marketing), Ratnagiri, is appointed as mediator in place of Mr. Pethe by consent of the parties.

In that view of the matter, parties to appear before mediator on 13th October 2025.

The mediator shall submit his report to this Court by 10th December 2025.
