The applicant is seeking regular bail in crime no. 69 of 2021 registered with Kadegaon Police Station, Sangli, DistSangli for the offences punishable under Sections 302, 324, 323, 504 and 506 read with Section 34 of Indian Penal Code, 1/3
1860.

It is prosecution's case that on 5th March, 2021, the applicant and co-accused assaulted the husband of the first informant with wooden stick and wooden rod and murdered him on the ground of land dispute. It is alleged that the applicant and co-accused also assaulted the first informant and his mother-in-law when they try to intervene. 3.
It is the contention of learned counsel for the applicant that the applicant is behind bar more than four years. Investigation is completed. Charge-sheet has been filed. There is no progress in trial. Hence, requested to allow the application. 4.
It is contention of learned APP that the earlier bail application of the applicant was rejected by this Court (Coram : N. R. Borkar, J.). It was carried to the Hon'ble Apex Court and the said order is confirmed by the Hon'ble Apex Court. As the bail application of the applicant is already rejected by this Court, this application is not maintainable and requested to reject the application.

I have heard all the learned counsel, perused the FIR and documents produced on record.

This Court (Coram : N.R. Borkar, J.) by order dated 18th April, 2023 rejected the earlier bail application of the applicant and the said order was carried to the Hon'ble Apex Court. The Hon'ble Apex Court confirmed the order of this Court on 29th August, 2023 and rejected the application of the applicant. The applicant is seeking bail on the ground of long incarceration. As the earlier bail application on the same ground of the applicant is rejected, I pass following order:
ORDER
Application is rejected.

Bail Application is disposed off.

In view of disposal of Bail Application, Interim Application is also disposed off.
