This application is for deleting the name of deceased Respondent no.3 and treating the respondent nos. 4 and 5 as legal heirs of deceased respondent no.3.

Considering the submissions made by the learned counsel for the Applicant and the averments made in the Application, I am satisfied that the Applicant has made out a case for allowing the present Civil Application.

ORDER

a) Delay in preferring the Civil Application is condoned.

b) Applicant is permitted to delete the name of respondent no.3 from the cause title of Second Appeal no. 845 of 2002.

c) Applicant is permitted to show the respondent nos. 4 and 5 as legal heirs of deceased respondent no.3.

d) Applicant to carry out appropriate amendment within four weeks from today.

e) Civil application stands disposed off accordingly.
